Gentika S.r.l. (“Gentika”, “we”, “us” or “our”) respects your privacy. This Privacy Policy explains how we collect and process personal data when you visit gentika.ai, contact us, request or use a demonstration, or otherwise interact directly with Gentika.
1. Who we are
Where Gentika determines the purposes and means of processing personal data, the data controller is:
Gentika S.r.l.
Via Don Minzoni 8
10121 Torino (TO), Italy
VAT No. 13482710012

2. When this Privacy Policy applies
Gentika's role depends on how you interact with us.
Gentika generally acts as data controller when you visit our website, contact us, request a demo or commercial information, use a demonstration operated directly by Gentika, or interact with us as a customer, prospective customer, supplier, partner or other business contact.
Gentika also provides AI commerce technology that retailers integrate into their own websites and digital services. When Gentika processes personal data through a retailer deployment on the retailer's instructions, the retailer acts as data controller and Gentika acts as data processor.
In those circumstances, the retailer's privacy notice governs the processing and explains how you can exercise your rights. Gentika processes personal data in accordance with the retailer's instructions and the applicable agreement and data-processing terms.
Unless otherwise stated, the sections below describe processing for which Gentika acts as controller.

Usage and analytics information
We may process information about how our website and Gentika-operated experiences are used, including interaction patterns, performance information and aggregated statistics.
4. Sources of personal data
We generally receive personal data directly from you.
In a business context, we may also obtain professional contact information from publicly available professional or company sources, referrals, your organisation or business information providers, where permitted by law.
5. How we use personal data
We may process personal data to:
- operate, secure and maintain our website and services;
- provide demonstrations and AI-powered experiences;
- respond to enquiries and communicate with you;
- arrange demonstrations and evaluate potential projects;

- comply with legal obligations and protect our legal rights.
Where Gentika processes personal data on behalf of a retailer, we process that data according to the retailer's instructions and the applicable agreement and data-processing terms.
We may use information that has been aggregated or de-identified so that it no longer constitutes personal data for analytics, security, statistical and service-improvement purposes, where permitted by the applicable agreement and law.
Business communications
We may use business contact information to communicate about Gentika, including with prospective business customers, where permitted by applicable law.
Where consent is required for a particular communication, we will obtain it. You may object to direct marketing at any time.
6. Legal bases
Where the GDPR applies, we rely on one or more of the following legal bases:
Contract or pre-contractual steps, where processing is necessary to provide something you request or to enter into or perform a contract.
Legitimate interests, where processing is necessary to operate and secure Gentika, respond to business enquiries, manage business relationships, improve our services or develop our business, provided those interests are not overridden by your rights and interests.
Consent, where required, including for non-essential cookies or similar technologies and certain marketing activities.
Legal obligations, where processing is necessary to comply with applicable law.
Where we rely on consent, you may withdraw it at any time. Withdrawal does not affect the lawfulness of processing carried out before consent was withdrawn.
7. AI-powered interactions
Gentika uses AI systems to process requests and generate responses, recommendations and other shopping-related outputs.
When you interact with a Gentika-powered AI experience, information submitted during the interaction may be processed by Gentika and by technology providers involved in operating the relevant service.
AI-generated outputs may be inaccurate, incomplete or unexpected and may vary in response to similar inputs. Product information may also change over time. Important information such as price, availability, promotions, variants and other transaction details should be verified in the retailer's current storefront and checkout.
8. Service providers and other recipients
We use selected service providers to host, secure, operate and support Gentika, including providers of cloud infrastructure, AI processing, communications, analytics and related technical services.
Where these providers process personal data on our behalf, we require them to protect it in accordance with applicable contractual and legal requirements.
We may also disclose personal data where required by law, where necessary to establish, exercise or defend legal rights, or in connection with a merger, acquisition, reorganisation or sale of all or part of our business, subject to applicable safeguards.
9. International data transfers
Some service providers may process personal data outside the European Economic Area (“EEA”).
Where personal data is transferred outside the EEA and the destination is not recognised as providing an adequate level of protection, we use an appropriate transfer mechanism where required, such as the European Commission's Standard Contractual Clauses, together with supplementary safeguards where appropriate.
10. Data retention
We retain personal data only for as long as necessary for the purposes described in this Privacy Policy.
Retention depends on the type of information and the context in which it was collected. For example, business correspondence may be retained for the duration of our relationship and for an appropriate period afterwards. Technical and security logs may be retained for shorter periods unless they are needed to investigate an incident, protect our legal rights or comply with legal obligations.
Where Gentika processes personal data on behalf of a retailer, retention is determined by the retailer's instructions and the applicable agreement and data-processing terms.
Information that has been aggregated or de-identified so that it no longer constitutes personal data may be retained for longer periods.
11. Security
Gentika maintains appropriate technical and organisational measures designed to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access, taking into account the nature and risks of the relevant processing.
No method of transmission or storage can guarantee absolute security.
12. Payment information
Gentika's standard shopping-agent service is not designed to collect or store payment-card information.
Checkout and payment are handled through the relevant retailer's commerce and payment systems.
13. Providing personal data
Certain information may be necessary for us to respond to a request, provide a requested service or enter into a contract.
If you do not provide that information, we may be unable to fulfil the relevant request or provide the relevant service.
14. Your rights

- access personal data concerning you;
- correct inaccurate or incomplete personal data;

- lodge a complaint with a competent data-protection authority.
These rights may be subject to conditions and exceptions under applicable law.
Where Gentika acts as controller, you can exercise your rights by contacting info@gentika.ai.
Where Gentika processes your information on behalf of a retailer, you should normally direct your request to that retailer. Gentika assists its customers in responding to applicable data-subject requests.
You may also lodge a complaint with the Garante per la protezione dei dati personali in Italy or another competent supervisory authority.
15. Children
Gentika's corporate website and Gentika-operated demonstrations are not directed to children, and we do not knowingly seek to collect personal data from children through them.
16. Third-party services
Our website may link to third-party websites and services, including retailer websites, scheduling services, video platforms and social networks.
Those third parties process information according to their own terms and privacy practices. Gentika is not responsible for the privacy practices of independent third parties.
